General terms and conditions of use of the website

PrestaShop is the designer and publisher of an open-source software solution, distributed under a free license (Open Software License OSL-3.0), allowing its users to create e-commerce sites.

This solution, called Solution Edition, can be downloaded from the PrestaShop website www.prestashop.com.

It allows its users to personalize their e-commerce site and add additional features, free or paid, freely developed by the PrestaShop community already integrated or accessible on the marketplace PrestaShop.

The benefit of PrestaShop services is exclusively reserved for professionals within the meaning of French consumer law.

These general conditions of use (CGU) govern the conditions of access and use of the Help Center accessible at the address https://help-center.prestashop.com/fr (the « Help Center » ), published by PrestaShop. They form, with thePersonal data protection policy and the general conditions of use of the prestashop.com site, full terms of use.

PrestaShop reserves the right to modify these T&Cs at any time. If applicable, the modifications will take effect fifteen (15) days after their publication on the Help Center.

1. Definitions

General conditions of use or CGU: designates these general conditions, including their possible annexes and modifications.

Marchand: designates any natural or legal person acting in a professional capacity and operating a Merchant Site.

Services: designates the service(s) presented by these General Conditions.

PrestaShop: designates the limited company with capital of 430,645.65 euros, whose head office is located at198 Avenue de France, in PARIS (75013), registered with the Paris RCS under number B497916635.

PrestaShop Account: designates the account allowing the User to authenticate and access the services offered by PrestaShop.

User: designates any natural or legal person, Merchant, Technical Service Provider acting on behalf of a Merchant or Seller using the Services subject to these General Conditions.

Seller: designates any natural or legal person, professional, other than PrestaShop, having developed one or more Addons referenced on the PrestaShop Marketplace.

2. Acceptance of the T&Cs

Use of the Help Center is subject to full acceptance of these T&Cs.

The user acknowledges in this respect that his navigation on the Help Center is subject to his complete and unreserved acceptance of these T&Cs.

3. Object of the Help Center

The Help Center provides Users with information on Prestashop's activities as well as its products and services. Its use is free.

It also provides access to documentation useful for resolving problems that Users are likely to encounter.

Certain features require the creation of a PrestaShop Account and are therefore only available if you provide personal data via forms. The data that must be provided is identified by an asterisk (*).

The User undertakes to provide accurate, complete and up-to-date information. If this mandatory data is omitted, PrestaShop reserves the right not to provide access to these features.

4. Availability

PrestaShop will make its best efforts to make the Help Center accessible 24 hours a day, 7 days a week without being held to an obligation of result. PrestaShop may at any time suspend, limit or interrupt access to the Help Center or certain of its pages in order to carry out updates, modifications to its content or any other action deemed necessary for its proper functioning.

PrestaShop ne guarantees under no circumstances the availability, access and continuity of the Help Center and its services. Its unavailability, whatever the cause, does not entitle the User to any right to compensation.

5. User Commitments

The User undertakes to make correct, appropriate and fair use of the contents and services of the Help Center, in accordance with these T&Cs and not to use the services available on the Help Center for the purpose of harming PrestaShop or any User.

Any illegal or illicit activity and/or contrary to good morals or public order is strictly prohibited.

6. Intellectual property

The texts, brands, domain names, acronyms, logos, designs and others appearing on the Help Center, their design, selection, presentation and organization are protected by intellectual property rights belonging to PrestaShop.

Use of the Help Center does not imply any transfer of intellectual property rights, relating in particular to its content, to the PrestaShop brand.

The use of the PrestaShop brand in a domain name is strictly prohibited.

7. Personal data

Personal data collected on the Help Center is processed in accordance with our Personal data protection policy.

8. Link to other websites

The Help Center contains links to third-party websites, in particular to agency sites, partners or even social networks.

Said sites are not published by PrestaShop, which as such cannot be held responsible for the content published on them or for any damage resulting from navigation on these third-party sites by the User.

9. Disclaimer

PrestaShop is only responsible for the content published by it.

More generally, PrestaShop cannot be held responsible for:

  • any damage or loss incurred by the User when accessing the Help Center and using its functionalities,
  • the use of the Help Center made by the User,
  • any activity which would constitute a violation of the T&Cs by the User,
  • any damage that may be caused to the User's equipment due to a virus contracted while browsing the Help Center or any other damage caused by the User's browsing.

The User is solely responsible for any loss or damage, material or immaterial, which results from the use of the Help Center.

10. Applicable law and competent jurisdictions

These T&Cs are subject to French law.

Any dispute between the parties relating to the interpretation or execution of the T&Cs will be the subject of an attempt at amicable settlement.

Failing this, the parties assign jurisdiction to the Commercial Court of Paris (France), notwithstanding plurality of defendants or warranty claims, emergency procedures or precautionary procedures.
